Unindicted Co-Conspirator

AZ Impostor Electors Indicted

Part of the attempted coup d'etat that peaked on January 6, 2021, was an effort to put Trump electors in place in states that Joe Biden won. In Arizona, the state Attorney-General has finally brought charges against the 11 electors and some of the higher-ups in the Trump campaign. This includes Rudy Giuliani, Mark Meadows, Charles Eastman and Boris Epshteyn. Not indicted, but cited as a co-conspirator, is one Donald J. Trump of Florida. He was also an unindicted co-conspirator in the case that send Michael Cohen to prison. The charges include felony fraud, forgery and conspiracy. This trial should prove helpful to the Democrats in Arizona.

There are other states where the fake electors (impostor electors is a better term) were not charged after an investigation. In both Pennsylvania and New Mexico, the local GOP tried to get Republican electors seated just like in Arizona and a few others. The difference is noted in the Washington Post, which wrote, "The Republicans in New Mexico included wording in their paperwork saying their electoral votes should be counted only if they were found to be legitimate electors." That allowed them to get off the hook because there intention was not nefarious. Similar wording saved the impostors in Pennsylvania.

In Arizona, they did not hedge their bets in that way. They posted on social media that they were the real electors. Their documents purported that they were duly chosen, although they were not. In short, not only did they not protect themselves with the "just in case" argument," they went further to argue that they had won, when clearly they had not. One must recall Arizona was the site of the forensic review of ballots by the Cyber Ninjas, a joke of an operation that found there had been a miscount. They discovered 383 Biden ballots that had not been added to the totals. They knew they had lost and pretended anyway.

Of course, the whining on the right began immediately. The WaPo also wrote:

A number of those who were charged immediately denied the accusations or insisted they were politically motivated and vowed to fight them in court. George Terwilliger, a lawyer representing former Trump White House chief of staff Mark Meadows, called the indictment "a blatantly political and politicized accusation" that "will be contested and defeated."

One cannot help but wonder what the accused will do now. The smartest one will run to the AG and offer up everything in exchange for immunity. A smart AG will grant it and then, throw the book at the others.

Also, one wonders if the AG decided not to charge the ex-president because the case could not be proved beyond a reasonable doubt or whether such an indictment is forthcoming. It could be a case in which both are true. If someone were to get a plea deal, it could well be that Mr. Trump and others see a superseding indictment that adds their names to the case based on evidence that the AG does not have right now but will acquire with the deal.

When all is said and done, however, the effect is case is going to have on the election this November in Arizona is clear. Between this and the abortion saga, the state is poised to go Democratic in the general election. If that were to happen, it would just about guarantee a win for Joe Biden nationally. Without the 11 electors from Arizona, the path for Mr. Trump to reach 270 electoral votes is virtually impossible.
